Licensed Independent Adjuster Course Guidelines

Topics to be included in the Continuing Education Courses

The California Department of Insurance announced as of January 1, 2009 the changes to both the independent and public insurance adjuster licensing laws will take effect as a result of the passage of Assembly Bill 2044 (Duvall, Chapter 300, Statutes of 2008). There were several changes resulting from this bill, including many changes for the purpose of allowing California’s independent adjuster and public adjuster licensing laws to be uniform with other states. Listed below are the independent adjuster and public insurance adjuster changes that will take effect.

New Independent Insurance Adjuster Continuing Education Requirement
Section 14090.1 of the California Insurance Code (CIC) was amended to establish a CE requirement of 24 hours during the two-year license term for California resident independent insurance adjusters.
Independent Insurance Adjuster courses will be available beginning January 2009.

New Public Insurance Adjuster Continuing Education (CE) Requirement
Section 15059.1 of the CIC was amended to establish a CE requirement of 24 hours during the two-year license term for California resident public insurance adjusters. Public Adjuster courses will be available in January 2009.

Important Note About the New CE Requirements
Both Independent and Public Insurance Adjuster licenses expire every two years on May 31st of even years (e.g. 2008). Individuals who receive their independent or public insurance adjuster license during the second year of the fixed two-year license term will be required to complete only 12 hours of CE.

Once the license is renewed, those individuals will then be required to complete the required 24 hours of continuing education.

Other Independent Insurance Adjuster Licensing Changes Sections 14091 and 14094 of the CIC were amended to reduce the grace period during which an expired independent insurance adjuster license or branch certificate may be renewed from five years to one year.

Section 14029 of the CIC was amended to clarify nonresident licensing requirements for independent insurance adjusters by deleting “in this state” so that the active direction, control, charge, or management of the independent insurance adjuster business may occur outside of California.
